Occupational Maternity Pay and FTC
Posted by HelenatWWT on Tue, 28/04/2009 - 11:19
Hi,
I have a member of staff who is pregnant, but her FTC is due to expire one month after her baby is born.
She has all the qualifying service requirements for 4 months occupational maternity pay and SMP.
I have three questions:
1 - do I end the FTC as normal, and therefore she won't get the full OMP
2 - I understand that I am liable for SMP, so how do I pay this if her FTC has ended as normal.
3 - if I have to pay SMP and keep her on the payroll, doesn't this mean that her contract is automatically extended until the end of her maternity leave - in which case am I liable for full OMP?
For the record, I have absolutely no problem with her being pregnant and I am really pleased for her.
Many thanks
Josephine.
