Return to Work From Maternity Leave

Hi,

We are a small company and have tried to be as flexible as possible when considering return to work from maternity leave requests.

One request that we granted was for someone to return from 5 days to 3 days on the same pro-rata pay and bens and then after a subsequent return from her second maternity leave in June, to come back for 2 days.

Since the first request our business has changed and there is now a requirement for senior employees to travel with work, we are therefore finding that we are struggling to manage the workload as our part time employee cannot do it.

We now have someone else on maternity leave who has the same role as our part time employee but on a full-time basis and we are concerned that should she request part time, we would struggle to accommodate it.

Are we entitled to refuse the request, even though we have granted it in the past to someone else?

Also, if we do offer flexible working, can we alter her pay and bens in recognition that she will not be able to fulfill the role in it's entirety?

Hello! And welcome back as we enter 2012, with a busy year ahead of us all. With talk of double-dip recessions, a possible partial or even full break-up of the Eurozone and unemployment rates set to hit nearly 9%, topics such as organisational streamlining, staff resilience and talent management are likely to be on many an HR professional's lips over the next 12 months.
 
But to lighten the gloom here in the UK, we also have the Queen's Diamond Jubilee and its attendant public holidays to look forward to at the start of June. Followed by two weeks of Olympic Games from 27 July to 12 August and the Paralympics from 29 August to 9 September, each generating their own excitement, but also issues to work through for hard-pressed HR departments trying to sort out the multifarious staffing issues in advance.
 
So with an interesting but challenging year to come, HRZone promises to be with you, supporting you all the way and providing our usual insightful blend of news, analysis, community blogs and expert comment to help you sort the wheat from the chaff.
