Equal pay and employee qualifications

Where I work we currently pay extra to those who have degrees, though there is no difference in job content for those people. A degree in any subject, regardless of relevance to the job, is regarded as good enough to justify this extra pay.
One employee has said this might be illegal and I would like to know, before I set hares running, whether he is right. Does anyone have experience in this area?
